A judge has handed defeat to a social services agency that dispatched police officers to an India-bound jetliner more than two years ago to take into custody a 7-year-old boy because he was being homeschooled.

Word of the victory – that the government is not allowed to terminate the rights of the boy's parents – comes from Ruby Harrold-Claesson, president of the Nordic Human Rights Council.

Harrold-Claesson, who also has been reinstated as the representative for the parents months after she was removed on the objections of the Gotland, Sweden, social services agency, said it's a hopeful sign in the long-running custody dispute over Domenic Johansson, now 10.

During a December 9th preliminary hearing, the Johanssons and representatives of Gotland Social Services were asked to present evidence supporting or refuting the need for custody transfer. STOCKHOLM, October 12, 2011 (LifeSiteNews.com) - Swedish authorities that seized a seven-year-old boy from his family because the parents chose to homeschool him are threatening the parents with permanent loss of their child and a complete termination of their parental rights.

Swedish police snatched Domenic Johansson, son of Christer and Annie Johansson, in June 2009 from an airplane bound for India, Annie’s homeland. The main reason for the seizure was that Domenic was homeschooled. Since then Domenic’s entire family has been denied virtually any contact with their son.

Domenic, now 9 years old, has been held in state foster care for more than 24 months.

In June 2010, the Home School Legal Defense Association (HSLDA) and the Alliance Defense Fund (ADF) filed a joint application on behalf of the Johansson family at the European Court of Human Rights (ECHR) and have been working to support the family since shortly after Domenic’s seizure.

“The United States Supreme Court has called the termination of parental rights the family court equivalent of the death penalty,” stated Michael Donnelly, Director of International Relations at the Home School Legal Defense Association.

“The government shouldn’t abduct and imprison children simply because it doesn’t like homeschooling. That’s bad enough. But now the state is going even further by attempting to get the parents out of the way altogether,” said ADF Legal Counsel Roger Kiska. “This simply cannot stand. We will do everything in our power to help reunite this family.”

Both ADF and HSLDA are currently asking for letters to be written to Swedish officials and embassies in an attempt to renew attention to the family’s case and to encourage Swedish officials to release Domenic back to his family.

Why this is Important

“[A child] shall, wherever possible, grow up in the care and under the responsibility of his parents…” Declaration of the Rights of the Child (1959)

Christer Johansson, a Swedish citizen, and Annie Johansson, an Indian citizen, were recently informed by the Social Services in Gotland Kommun of their intention to transfer full custody of their son Domenic to a foster family. This is allegedly in the best interest of Domenic. However, Social Services have failed to demonstrate a single report of negligence or physical or emotional abuse by this family. Indeed, Social Services have engaged in an inhumane campaign of alienation: not allowing visitation or any communication between Domenic and his parents since November 2010.

Domenic Johansson has suffered physical and emotional deterioration due to the unfounded and cruelly prolonged isolation from his parents, extended family, and friends. He has not been allowed to even keep contact with other relatives and friends, in violation of the general rules outlined in Swedish law 22 § tredje stycket SoL. While in the care of Social Services, Domenic has been taken on several occasions to the hospital with stress-induced vomiting, the result of forced isolation from his biological family, which had constituted his sense of security and basic emotional identity. Domenic has both a Swedish father and an Indian mother with strong extended family ties. However, Gotland Social Services has ignored this Swedish regulation: A “[b]oard should be particularly vigilant with regard to immigrant children since many of them come from cultures where family membership has a different meaning than we are accustomed. A broken contact with family and community may at worst lead to isolation and disorientation in adulthood (Bill 1989/90: 28 p. 73).”

We demand a full investigation into the handling of this case by the Gotlands Kommun Social Services and the court appointed lawyers of Domenic Johansson (Eva Ernstson), Christer Johansson (Lars Dahlstrom) and Annie Johansson (Shantu Brahmbhatt). In direct defiance of Swedish and European Union laws, Gotland City Courts have violated the Johansson family's guaranteed rights to be represented by the lawyer of their choice. They have instead appointed lawyers with little previous experience, who uncritically accepted social services statements regarding the physical and psychological state of child and parents even though they were never corroborated by experts and who, therefore, undermined their clients’ rights to a fair trial. The system has failed this family and many others and must be changed.

We demand the immediate reunification of the family and that steps be taken to restore the emotional and psychological bond so abruptly broken by the unwarranted actions of the Social Services at Gotland Kommun.

Swedish officials on the Island of Gotland are moving to terminate the parental rights of homeschool parents Christer and Annie Johansson. The state seized 7-year-old Domenic in June 2009. Currently 9 years old, the boy has been held in state foster care for more than 24 months. Domenic’s entire family has been denied virtually any contact with him during that time.

Now, the state wants to give permanent custody to the foster family.

Jag är mycket orolig över hur familjen Christer, Annie och Domenic Johansson har blivit behandlade av svenska myndigheter. Jag har tagit del av domstolsprotokoll, vittnesförhör och familjens egen berättelse och jag kan inte förstå hur det har kunnat gå så långt som till ett LVU-omhändertagande av Domenic. Som svensk medborgare trodde jag att omhändertaganden och familjehemsplacering av ett barn i vårt land gjordes när ett barn far illa på grund av att föräldrarna utgör ett allvarligt hot mot barnets hälsa och utveckling, så som fallet är där till exempel missbruk, fysisk och psykisk misshandel förekommer. Enligt vittnen och närstående till familjen finns inga sådana missförhållanden i detta fall. Tvärtom var barnet Domenic ett lyckligt, älskat och friskt barn när han levde med sin mamma och pappa.

Om det som står i domstolsprotokollen ska ligga till grund för en sådan drastisk åtgärd som denna, att hålla barn och föräldrar splittrade och åtskilda på detta sätt, riskerar vart och vartannat barn i detta land att bli familjehemsplacerat.

Vi vet att sociala myndigheter fattar felaktiga beslut, vi hör och läser om detta ibland. Jag anser och är fullt övertygad om att detta fall just är baserat på ett sådant felaktigt beslut.

Sverige är känt utomlands för att vara ett barnvänligt land, där man värnar om barnets bästa. Fallet med familjen Johansson har fått tusentals människor i olika länder att reagera och engagera sig och förskräckt undra vad som pågår i Sverige.

Jag vädjar nu till Er som kammarrättsråd i detta mål att göra allt som är möjligt för att återförena denna splittrade familj snarast och låta Domenic få leva sin resterande barndom tillsammans med sin mamma och pappa.

The Alliance Defense Fund, the Home School Legal Defense Association and local Swedish counsel have filed a second application on behalf of Annie and Christer Johansson to the European Court of Human Rights in Strasbourg. Nearly two years ago, as the Johansson’s and their seven year old son Domenic were on a plane ready to move to India to engage in missionary work with orphanages, Swedish police boarded their plane and took young Domenic into foster care simply for being home educated. Since that time, the family has not been allowed to use the lawyer or legal defense of their own choosing within Sweden despite no objective reason for Swedish court’s to reject this most basic of requests.

Christer, whom was arrested and imprisoned for several weeks among serious criminals without ever seeing a judge simply for taking Domenic home for one day without permission (he called the police the following day to let them know he was at his parents’ home with his son), was also forced to use a state appointed lawyer in his criminal proceedings despite having the financial resources to appoint his own lawyer. The claim filed by ADF and HSLDA makes clear that in a democratic society, it is unacceptable for Sweden to force legal counsel onto a family without any objective cause to do so and to reject a defendant’s right to use the lawyer of their own choosing. Court Ordered Forensic Psychological Evaluation finds Johansson Psychologically Healthy

We've received word that Christer Johansson was released from police custody today immediately following a court hearing which was held as a continuance of the previous hearing of December 20, 2010. The original December 20th hearing was held as a result of an impulsive act on behalf of Johansson when on November 22, 2010, he took his son Domenic home, without permission, from a state supervised visit. According to Chapter 4 section 2 of the Criminal Code, this is punishable with prison for a minimum of one and maximum of ten years. Removing a child under fifteen years of age from the social services can constitute a crime against freedom or the promotion of escape and is punishable with fines or a prison sentence of up to one year.

During the December 20th hearing, the presiding judge, Lagman Mikael Mellqvist, withheld sentencing until Johansson had undergone a lengthy forensic psychological analysis. That analiysis, completed and submitted to the courts just this week, found Mr. Johansson to be psychologically sound.

This psychological finding is in direct opposition to the accusations made against Johansson by Gotland Social Services during both the December 2009 and September 2010 hearings to determine if Domenic should be returned to his parents or remain a ward of the Swedish state. In both court hearings, the Johanssons provided psychological reports stating Mr. Johansson was without a psychological diagnosis. However, Gotland Social Services continues to insist that Mr. Johansson suffers from a narcissistic disorder, while independent psychological assessments find him psychologically healthy. And now, in today's criminal proceedings the lengthy forensic psychological assessment, has found Mr. Johansson free of any psychological disorder.

In June 2010, HSLDA and the Alliance Defense Fund (ADF) filed a joint application at the European Court of Human Rights (ECHR) on behalf of the Johansson family. Since the Johanssons’ case has been heard at every level of the Swedish court system, the ECHR is the family’s only remaining recourse.

Although more than six months have now passed, the ECHR has failed to address the application, even though a special emergency measures order was requested. It is highly unusual that the Johanssons’ application still has not been assigned a case number. The court has also not responded to a letter requesting an explanation for the unusual delay. Instead, the application languishes while the Johanssons continue to endure the forced separation from their 9-year-old son Domenic.

Background

In June 2009 Swedish police boarded a plane where the Johanssons were leaving the country for Mrs. Johansson’s home country of India. The police had no warrant and did not charge the Johanssons with a crime.

The family continues to be kept apart through the deplorable actions of Swedish government officials. Nine-year-old Domenic remains in state foster care, now separated from his parents Christer and Annie for over 18 months. Sedan 1996, varje år inför jul, skickar Nordiska Kommittén för Mänskliga Rättigheter - NKMR - För skydd av Familjers Rättigheter i de nordiska länderna, en likalydande appell till de nordiska monarkerna och statsöverhuvuden, med anhållan om att Ni skall utöva Ert inflyttande för att de tiotusentals tvångsomhändertagna barnen i Era respektive länder skall få fira julen med sina nära och kära.

I sitt nyårstal till nationen, förhoppningsvis inspirerad av NKMR:s appell, berörde Norges Kung Harald barnens utsatta situation så som återgivits i Aftenposten 1997-01-02 enligt följande:

"Det sies at vi alle blir født som originaler. Lever vi lenge nok, er det imidlertid en viss fare for at vi dør som kopier. (...) For de yngste er det kanskje aller vanskeligist. Barneårene er de mest sårbare, og støtteapparatet er ikke alltid like godt. Jeg vil benytte anledningen til å berømme alt arbeid som gjøres til beste for barn og unge av offentlige og private engasjement. Under de gångna åren har åtskilliga fall av grov vanvård av barn som har tvangsfjernats / tvångsomhändertagits från sina föräldrar och placerats i fosterhem bland vilt främmande människor uppmärksammats såväl i statliga utredningar som i media.

I Norge har erstatning / skadestånd börjat betalas ut till offren för barnevernets / de sociala myndigheternas och deras uppdragstagarnas brutalitet mot barnen som de borde ha skyddat och gett bättre förhållanden än dem som de påstods ha haft i sina biologiska familjer.

Tiotusentals fall av vanvårdade fd fosterhems- och institutionsbarn finns i Danmark, Finland, Norge och Sverige. Förhållandena för de tvangsfjernede förr och nu är likadana i de nordiska länderna. Detta har dokumentärerna "Stulen barndom" och "Ekbackens behandlingshem" och reportaget om Godhavnsdrengene visat.

Den statliga svenska utredningen ”Vanvård i statens regi”, belyser i sina delrapporter och senast i delbetänkandet publicerat 2010-01-14, att situationen har varit helt oacceptabel för åtskilliga tiotusentals fosterhems- och institutionsplacerade barn. Men trots flera larmreportage om bristande rättssäkerhet för de tvångsomhändertagna och missförhållanden i nutida fosterhemsvården, har inte regeringen eller annan ansvarig myndighet vidtagit några åtgärder i syfte att inte de tvångsomhändertagna och fosterhemsplacerade barnen ska skadas ytterligare.

Något som är mycket allvarligt är att dagens fosterhemsplacerade barn hindras systematiskt från att fira Julen - familjens största högtid - med sina föräldrar och släktingar. Detta är synnerligen grymt och hjärtlöst.

T ex kan jag åberopa fallet med de fyra bröderna i Arvika som är tvångsomhändertagna och placerade i två olika fosterhem. De tre äldsta pojkarna utgör inkomstförstärkning åt en familj med svaga inkomster och ett handikappat barn. De två äldsta pojkarna har råkat ut för åtskilliga svåra "olyckor" i fosterhemmet, men polis och åklagare och socialtjänsten vägrar ta sitt ansvar. Den yngsta brodern är utsatt för en förtäckt adoption. Han är placerad hos ett barnlöst par och samtliga bröder hotas av vårdnadsöverflyttning på fosterfamiljerna.

I år tänker vi också särskilt på lille Rabie Gueblaoui som Kalla Fakta rapporterade om dels den 27 september resp. den 25 oktober 2004. Lille Rabie är sjuk men enligt hans föräldrar nekas han den vård som han behöver och har rätt till. De sociala myndigheterna har hindrat Rabie från att träffa sina föräldrar under ett par års tid. Han är fortsatt tvångsomhändertagen och fosterhemsplacerad. Vi tänker också på Domenic Johansson som, under traumatiska förhållanden, togs från flygplanet på Arlanda flygplats den 25 juni 2009 och separerades från sina föräldrar när de skulle lämna Sverige för att bosätta sig i sin mors hemland, Indien. Domenics far, Christer Johansson, sitter häktad sedan den 26 november 2010 på grund av att han tog sin son från ett av de "en timme en gång var femte vecka" övervakade umgängestillfällena. Ytterligare ett fall som vi tänker på är Karlstadsfamiljen vars fyra barn tvångsomhändertogs i början av sommaren 2010 pga att familjen använde sig av fysisk tillrättavisning i barnuppfostran. Socialtjänsten har beslutat att den här familjen, som de har slitit i bitar, får träffa varandra under två timmar den 27 december!

Nu inför den instundande julen vädjar jag, undertecknad, Ruby Harrold-Claesson, jur. kand., ordförande i NKMR, att Ers Majestät Kung Carl XVI Gustav, statsministern Reinfeldt, socialministern, socialförsäkringsministern, justitieministern, ja hela regeringen och generaldirektören för socialstyrelsen skall ålägga de ansvariga inom landets socialnämnder att de skall tillse att de familjer som har kämpat - och fortfarande kämpar - för en återförening med sina tvångsomhändertagna och fosterhemsplacerade barn skall få uppleva Julen 2010 tillsammans.

Inför rätta för att ha fört bort sonen

Ska genomgå rättspsykiatrisk undersökning

En 41-åring som åtalats för olaga frihetsberövande skall genomgå en rättspsykiatrisk undersökning. Han avvek med sonen när de skulle ha övervakat umgänge och de var försvunna under två dagar. En person är också anhållen i sin frånvaro för medhjälp efter att ha väntat i en hyrbil som de bytte till.

I bakgrunden finns en utdragen tvist mellan föräldraparet och olika myndigheter. Något som bland annat medfört att sonen en längre period inte gick i skolan och slutligen under dramatiska former omhändertogs i ett plan på Arlanda när familjen skulle lämna landet för att resa till Indien. Efter detta är sonen LVU-placerad i familjehem. Enligt beslut får föräldrarna endast träffa honom en timme var femte vecka och då under övervakning.

22 november skulle ett sådant äga rum. Familjehemsmamman (som hördes utan pappan närvarande i salen) kom gående med barnet över parkeringen vid socialförvaltningen på Polhemsgatan i Visby där mötet skulle äga rum. Då körde pappan fram, tog sonen till bilen och körde i väg.

Enligt 41-åringens och sonens berättelse (som spelades upp i form av ett videoförhör) åkte de till en parkeringsplats där de bytte till en hyrbil. (I denna väntade en annan man som är misstänkt för medhjälp och anhållen i sin frånvaro). Pappan och sonen höll sig sedan gömda i en bygdegård och i en stuga och slutligen hos släktingar på södra ön. De höll sig undan i två dagar varefter pappan under kontakt med polisen berättade var de fanns.

Stormning
- Att återlämnandet skedde under stor dramatik med många poliser beror på polisen, menade 41-åringens försvarare Shantu Brahmbhatt.

- Jag ville inte ha någon stormning men det gick inte att hejda att det blev en enorm stormning, sade pappan.

Han nekade till att det handlade om något planerat brottsligt utan om en enorm längtan efter att få tillbringa en stund själv med sonen, något som byggts upp under lång tid.

Två dagar
Åklagaren Mats Wihlborg menade i sitt slutanförande att det var helt uppenbart att barnet förts från platsen mot sin vilja och att det tog två dagar innan de lokaliserades. Han yrkade på att pappan skulle genomgå en rättspsykiatrisk undersökning, om fängelse blir aktuellt handlar det om minst ett år.

Sonen krävde via sitt ombud 50 000 kronor i skadestånd för kränkning.

Försvararen menade att inget vittnesmål styrkte att fadern med våld tagit barnet och då handlar det inte om något frihetsberövande.

- Motivet ska ligga till grund och det är inte ett frihetsberövande utan att tillbringa tid ensam med barnet.

Hon krävde frikännande, motsatte sig en rättspsykiatrisk undersökning och krävde en påföljd inom öppenvården om mannen skulle fällas.

Rättens beslut blev att 41-åringen skall genomgå en rättspsykiatrisk undersökning. När denna är gjord återupptas målet och med undersökningsresultatet föreliggande avgörs om mannen döms till vård eller annan påföljd.

Socials Not Happy Family Has Gone Public
Johanssons Ask: What Would You Do For Your Children?

While employees of Gotland Social Services cloak their deeds behind a wall of secrecy, Annie and Christer Johansson have opened their entire lives to the world for scrutiny. "We have no choice. The world must know what is happening in Sweden. We've walked through fire for our son, and will continue to do so until he is returned to us," remarked Christer Johansson, as the September 2, 2010 court hearing challenging the Social's right to keep Domenic approached. "This is how much we love our son. What would you do for your children?"

Gotland Social Services are not happy with the Johanssons for making their story public. Yet, the Johanssons believe they have no choice but to bring their plight to public awareness, as it seems abundantly clear that Gotland Social Services has absolutely no intention of returning Domenic to his parent's care.

This writer is not related to the Johanssons, as some would believe. As a matter of fact, until the Johansson's story became public, spreading across the globe into the United States, this writer had never heard of Domenic, Annie and Christer. Instead, this writer has become interested in the Johansson case because of her own children, a sibling group of 4, whom she and her husband adopted three years ago.

Our adopted children's birth father is in jail for 30 to 50 years for the crimes he perpetrated against these children. The initial goal for our children was reunification with their birth mother. She had never personally harmed her children. Instead, she neglected their needs by not protecting them from their birth father. Even so, Child Protective Services were prepared to reunite her with her children once she completed one demand: attendance of parenting classes. Their birth mother was not asked to walk through fire. She was simply asked to better equip herself by attending parenting classes prior to reunification.

Curiously, our children's birth mother attended all required parenting classes but the very last. For two years, while her children languished in foster care, birth mom provided every excuse as to why she could not finish the classes, fully knowing she needed to do so for reunification to take place. While their birth mother was not required to walk through fire, for some reason she chose not to complete the required parenting course in an effort to have her children restored to her. After two years of waiting, the children were made available for adoption and now reside with us, their new family.

Reunification Never Offered

In contrast, Annie and Christer have not been charged with any crime or neglect. They've also not been given the opportunity for reunification with Domenic. They've not been offered parenting classes as a possible means of restoration. We are certain if they were, Annie and Christer would have taken the classes expeditiously and would have been star pupils, perhaps among the best to ever pass through such classes.

Annie and Christer have stated repeatedly in court their willingness to do anything, follow any program, and agree with every suggestion from Social Services, if only their child would be restored to them. The shocking fact is: Gotland Social Services has no interest in helping the Johansson family to be reunited. The health of this family is not Social Services' goal at all.

Instead, it appears Gotland Social Services' main intention is to permanently remove Domenic from the care of his parents. Why? Of what crime have Annie and Christer been accused? They've been accused of home schooling the boy - at a time when home schooling was legal in Sweden. They've been accused of delaying or forgoing immunizations - while such a parental decision is legal in Sweden. They've been accused of neglecting two cavities in his baby (milk) teeth - yet the existence of the cavities was not known until after the Socials snatched the boy. (Incidentally, Domenic had received regular dental care in the past, thus proving his parents were not neglecting him in this area. And even had he not, has the existence of cavities in baby teeth become a crime?)

The only requirements laid upon the Johansson family by Gotland Social Services has been total and complete acquiescence to the loss of Domenic. The Johanssons have never been offered a plan for reunification.

The Johanssons refuse to acquiesce to the loss of their child. Understandably so! Domenic is their son. They've loved and tenderly cared for him his entire life. No crime was ever perpetrated against the boy by Annie and Christer, nor anyone else. The only crime this writer, and thousands of others, see is a crime perpetrated by Swedish authorities. Whether purposefully or by mistake, the separation of Domenic from his parents for the aforementioned arbitrary reasons is criminal.

It is this writer's conclusion, and that of many others, that Annie, Christer and Domenic have fallen victim to a troubling movement in the halls of child protective services worldwide. It appears in many places the priority is not the aiding of citizens, families and children who are endangered or hurt. Instead, the priority is the forming of children according to the social engineering theories of powerful entities in government. The goal is, in fact, arbitrary power and control.

When child protective services remains centered upon their mission of actually protecting children from abusive and neglectful parents - as in the case of this writer's adopted children - children and parents are justly served. However, in the case of Domenic Johansson and - troublingly - a rising number of families across the globe, when child protective services removes a child from the home of loving and capable parents for arbitrary reasons, children and their parents are permanently traumatized, neither parent nor child is served, and the freedom of society is called into question.

Swedish courts have agreed to postpone the next Johansson court hearing until September 2nd, providing the family and their choice counsel more time to successfully appeal the mid-June decision removing from the case the highly respected human rights lawyer Ruby Harrold-Claesson, president of the Nordic Committee for Human Rights. The date for the new series of court challenges was originally fast-tracked and scheduled to be heard July 13 in Harrold-Claesson's absence.

As Friends of Domenic Johansson reported last month, Swedish courts banished Harrold-Claesson from the case after Domenic's appointed public "defender" (a position appointed by the court to represent the state) complained to the courts about Harrold-Claesson's participation. President of the Nordic Committee for Human Rights, Harrold-Claesson is a widely known and respected advocate for families in custody disputes with child protective services, and has won many such cases in Sweden, restoring dozens of children to the rightful arms of loving parents. She has since filed an appeal to her court ordered removal.

This new case, challenging the "keeping" of Domenic, was filed on behalf of the Johanssons by Harrold-Claesson just days before she was banished. The previous series of cases challenged the initial "taking" of Domenic. In those series of suits, the Johanssons were "represented" by court appointed counsel, resulting in Domenic's continued separation from his parents. It is for this very reason Christer Johansson has dismissed the original court appointed counsel and sought the hard-hitting Harrold-Claesson to represent him.

June 25, 2010 marked the one-year anniversary of the violent seizure of the then 7-year-old child. So traumatized was Domenic by the acts of armed police on behalf of the Visby Social Services board, witnesses tell us he vomited during and shortly after the shocking scene when uniformed Swedish police stormed an India bound jetliner just moments before take off. We are told the boy's mother, Annie, collapsed during the assault. The family was emigrating to India, Annie's home country.

By the end of 2009, the Johanssons had lost all their court appeals challenging the "taking" of their only child. In the December 2009 Chamber Court decision, the court sites as justification the fact that Domenic was home schooled (at the time legal in Sweden), that his parents chose to delay or forgo immunizations (also legal in Sweden) and that the boy had two cavities in his baby teeth.

Annie is a native of India. She emigrated with Christer to his native country of Sweden in 2001 after an earth quake hit India and the couple lost everything they owned in an attempt to start a small travel agency. At the time of the quake, Annie was pregnant with Domenic. The couple always planned to return to India where Annie's large family resides, and were finally doing so the day Domenic was seized.

Det var för ett år sedan som beväpnad polis på order från socialtjänsten på Gotland, stormade ett flygplan i Stockholm som var på väg till Indien, och med våld förde bort familjen Johansson.

Deras brott? De hade under en kort period hemundervisat sitt enda barn i ett land som ser med förakt på familjer som hemundervisar sina barn, och som precis denna vecka har antagit en ny skollag som gör hemundervisning olaglig över hela Sverige. Denna artikel går igenom familjen Johanssons liv och den svenska kammarrättens beslut i december 2009 som i verkligheten håller en familj fånge på Gotland.

När kulturer krockar
Eftersom modern är från Indien, växte Domenic upp på ett något annorlunda sätt än andra svenska barn, vilket naturligtvis gjorde att han anammade indiska sätt och sedvänjor. Annie, den nu åttaårige pojkens mor, tror på ett enkelt liv där mödrar själva uppfostrar sina barn fram till skolådern. Därför skrev Annie och hennes man Christer aldrig in Domenic på något dagis eller någon förskola och blev därför upprepade gånger trakasserade av socialtjänsten på Gotland för deras val att uppfostra Domenic hemma.

I Sverige är ett barn ovanligt om det inte börjar på dagis strax efter födelsen samtidigt som mödrarna återgår till arbetet. Domenic och Annie var undantaget, och inte regeln. Därför tilldrog sig deras levnadssätt uppmärksamhet. Mor och barn stannade hemma tillsammans varje dag, och åtnjöt den mest naturliga av relationer. Trots det lades detta faktum chockerande nog familjen till last i domstolsbeslutet från december 2009 om att fortsätta tvångsomhänderta Domenic. I domstolsprotokollet från december 2009 står det att ”… föräldrarna har tagit en risk genom att inte låta Domenic delta i barnomsorg och skolgång”. När, i mänsklighetens historia, har det varit en ”risk” att en mor själv uppfostrar sitt barn hemma?

”Lever i skuggan”
Domstolen har tydligt lagt Annies ställning som utlänning i Sverige henne till last. Det är nämligen så att Annies ursprungsspråk är engelska, men trots det har hon lärt sig att tala och läsa lite svenska sedan hon immigrerade till Sverige 2001. Å andra sidan pratar Christer både engelska och svenska flytande, liksom även Domenic. Under årens lopp har Christer till största delen stått för översättningen åt Annie och fört hennes talan. Gotlands socialtjänst har tolkat Annies beroende av sin man att kommunicera i hennes ställe som en svaghet, något som citeras i domstolsprotokollet från december 2009, vilket hävdar: ”Annie Johansson lever i skuggan av sin make.” Om du flyttar till ett främmande land med din make, som växte upp i det landet, skulle inte du också i stor utsträckning vara beroende av honom om du inte talade landets språk särskilt bra? Skulle ett sådant beroende göra dig olämplig som förälder?

Modern innehar magisterexamen men ”saknar förmågan”
Annie erhöll sin kandidatexamen (B.A.) från universitetet i Poona 1994 och sedan sin magisterexamen (M.A.) från universitetet i Pune, 1996. Hon studerade sedan vidare genom att både erhålla ett First Class-diplom i marknadsföring och public relations, också 1996, från Bombay Institute of Management Studies och ett diplom från Distinction in Information and Systems Management från Aptech Computer Education school 1998. Ändå lyckades socialtjänsten på Gotland övertyga kammarrättens domare att emedan Annie har ”viljan” att vara en god mor, en person med flera universitetsexamen, så har hon inte ”förmågan”. Besluten från december 2009 slår fast att ”Christer Johansson och Annie Johansson har viljan att agera som bra föräldrar men saknar förmågan”. Har du en magisterexamen, eller kanske bara en kandidatexamen? Om så, krävdes det inte ett visst mått av kunskap, självdisciplin, mogenhet och ”förmåga” för att erhålla den?

En berövad moders ”mående”
Enligt paret Johansson började socialtjänsten på Gotland under hösten 2008 att aktivt undersöka och trakassera dem efter att familjen meddelat den lokala skolan sin intention att hemundervisa Domenic under en kort period innan de skulle flytta till Indien. Den obligatoriska skolgångsåldern är 7 år i Sverige. Domenic blev 7 år i september det året. Vid den tidpunkten var hemundervisning fortfarande laglig i Sverige. I ljuset av den förestående emigrationen till Indien, agerade paret Johansson för sin sons bästa genom att göra ett val vad gäller undervisningen som på ett naturligt sätt skulle minimera avbrottet i hans studier medan de flyttade. Även om hemundervisning vid den tiden var laglig i Sverige, var många i myndighetsposition emot tillämpningen, vilket visade sig just denna vecka då den svenska riksdagen den 22 juni
godkände en ny skollag som gjorde hemundervisning olaglig i Sverige. År 2008 möttes familjen Johansson av motstånd mot sina hemundervisningsplaner både från tjänstemän på de lokala gotländska skolorna och från anställda på socialtjänsten. På detta sätt började förhören och undersökningen av familjen Johansson. Eftersom det var deras lagliga rätt, stod paret Johansson på sig i sitt beslut och hemundervisade Domenic under hans första skolår. Vid skolårets slut, tog trakasserierna från socialtjänsten ut sin rätt på Annie, men hon höll ändå ut. Emellertid, efter det att Sverige har ”kidnappat” hennes son, så har Annies hälsa försämrats kraftigt, vilket noterades i beslutet från december 2009: ”Hennes mående påverkar starkt hennes förmåga att vara förälder.”

Låt oss överväga detta i sammanhanget: I december 2009 hade familjen Johansson terroriserats av Gotlands socialnämnd under mer än 16 månader; de hade fått sitt hem invaderat och genomsökt av beväpnad svensk polis; de hade blivit förföljda av beväpnad polis, på begäran av socialnämnden, till själva slutet av flygplansplattan vid en internationell flygplats; de hade hjälplöst åsett då beväpnad polis stormade flygplanet där de var passagerare; de hade med våld tvingats av flygplanet; de hade, när de väl hade återvänt till flygplatsen, blivit lurade att gå med på att socialen skilde Domenic från dem genom att påstå att de bara skulle ta honom ”till rummet bredvid”, bara för att några minuter senare få reda på att han kvickt hade förpassats från flygplatsen och var på väg tillbaka till Gotland och in i påtvingad familjehemsvård. De hade utstått talrika möten med socialen då de bönade om att få tillbaka sin son; man hade ljugit för dem att han skulle återlämnas om tre dagar; de anklagades för att försumma honom på grund av två hål som upptäckts i hans mjölktänder, i efterhand, under de tre dagarna efter tvångsomhändertagandet; de hade tagit sig igenom tre nivåer av rättegångsförhandlingar i sina försök att få sin son återlämnad till sig; de han inte fått tillåtelse att se sin son förutom en timme var femte vecka. Alla dessa trauman som är begångna av staten, och kammarrätten bedömer Annies lämplighet som förälder utifrån hennes ”mående”! Hur ironiskt är det inte att samma människor som skapade terrorn och kaoset i familjen Johanssons liv är de som nu hävdar att Annie är olämplig att vara förälder på grund av sitt ”mående”. Den svenska socialtjänsten på Gotland har kränkt och slitit sönder en fredlig och kärleksfull familj. Nu bestraffar de den familjen på grund av deras lidanden.

Föräldrarnas vånda betecknas som ”bristande förmåga”
under övervakade besök
Beslutet från december 2009 indikerar att Domenic och hans föräldrar inte vet hur man interagerar med varandra under myndighetsövervakade besök. Protokollet slår specifikt fast att ”Både Christer och Annie Johansson uppvisar en bristande förmåga …. Det saknas en ömsesidig dialog och samspel”.
Sedan Domenics bortförande, har Annie och Christer kämpat sitt livs kamp mot krafter med till synes obegränsad makt och resurser. De tillåts träffa sitt barn under en timme var femte vecka under övervakning av myndigheterna, och tillåts prata med honom i telefon under 10 minuter varannan vecka också under övervakning av myndigheterna. Under dessa gånger av flyktigt interagerande med sin son, är de strängt begränsade i vad de kan säga och göra i Domenics närvaro och de övervakas hela tiden. Under ett besök började Annie, då hon blev överväldigad av känslor när hon såg sin son efter en sådan lång separation, gråta. Istället för att förstå och sympatisera med den smärta som Domenic, Annie och Christer upplevde, hotade den närvarande socialarbetaren dem, och sa åt dem att om Annie grät igen skulle besöket omedelbart upphöra. Kan du föreställa dig att du blir hotad med att förlora din värdefulla timme du har var femte vecka med ditt barn bara för att du beter dig naturligt, som en förkrossad mor som håller på att förlora sitt barn? Är det alls konstigt att de alla tre, Domenic, Annie och Christer inte vet vad de ska säga eller hur de ska bete sig under den ständigt närvarande granskningen av en närvarande socialarbetare? Trots det anklagas denna familj i kammarrättens beslut från december för att ha en ”bristande förmåga” när de träffar varandra under omöjliga omständigheter. Återigen, denna familj är straffad för lidanden skapade av staten. Hur långt måste vi sträcka vår föreställningsförmåga för att förstå den påfrestning som en relation mellan förälder och barn utstår när socialtjänsten för bort ett barn från sitt hem. Alltsedan deras separation har Domenic, Annie och Christer utstått stor förvirring och omöjliga anpassningar. Domenic såg fram emot att få börja sitt nya liv med sina föräldrar och stora familj i Indien, men blev istället tvingad att leva i främlingars hus i Sverige. Vid den tidpunkt då han skulle ha börjat skolan i Indien, tvingades han börja skolan i Sverige. På sin åttonde födelsedag nekades han tillstånd att träffa sina farföräldrar med anledningen, det var inte bra för honom, så farmor och farfar fick åka hem igen utan att ens säga hej eller vinka. När hans första jul borta från sina föräldrar kom, nekades han återigen tillstånd att besöka eller ens prata i telefon med föräldrarna han alltid har älskat. Istället tvingades Domenic att fira sin födelsedag och jullov med främlingar medan socialarbetarna omgav sig själva med familj, vänner och kära. Det finns också andra restriktioner. Paret Johansson tillåts inte att ta med sig gåvor och något extra gott till Domenic. Christers till åren komna far och hans rullstolsbundna mor, Domenics farfar och farmor, nära och kära för honom sedan födelsen, följde med familjen till de myndighetsövervakade besöken. Oförklarligt nog fick dessa vänliga människor ibland finna sig i att vara utestängda från besöksrummet. Ingen förklaring och inget skäl angavs.

Enligt paret Johansson har de blivit instruerade att alltid le när de ser Domenic och aldrigprata om separationen. I själva verket förväntas de agera som om allting är helt i sin ordning när de träffar sin son. De har inte friheten att berätta för Domenic att de inte håller med om att han bor i ettfamiljehem. De har inte friheten att berätta för Domenic att de kämpar för att få hem honom. Istället ska de, enligt paret Johansson, interagera med sin son på ett sådant sätt som uppenbarligen ska leda till att lille Domenic ska tro att hans bortförande från sin familj är helt acceptabelt för hans mor och far. Vi har dock ingen aning om vad socialarbetarna berättar för Domenic. Om hans far och mor inte har tillåtelse att prata om separationen och inte har tillåtelse att berätta för Domenic att de kämpar för honom, gör inte det att Domenic undrar vad hans föräldrar tänker? Gör inte det en liten pojke totalt förvirrad angående vad som hänt och utelämnad åt vilket budskap socialarbetarna och familjehemsföräldrarna väljer att berätta för honom? Barn anklagar självklart ofta sig själva för familjesvårigheter. Om Annie och Christer inte har tillåtelse att försäkra Domenic att han är älskad och att man är mån om honom och vill ha honom tillbaka hem, riskerar då inte denna lille pojke att lida mycket allvarlig och långvarig psykologisk skada? Vi undrar också vad som händer i Domenics familjehemsplacerade liv som han kanske är förbjuden att dela med sig av till sina föräldrar. Det står klart varför Domenic, Annie och Christer inte vet vad de ska säga eller göra när de träffar varandra. Denna familj har blivit inget annat än marionetter åt hjärtlösa marionettspelare. De har hotats till att göra och säga så lite som möjligt när de besöker Domenic. Frågan kvarstår: vad har Domenic fått berättat för sig eller gått igenom för att inte längre interagera naturligt med sina föräldrar? Varför lider Domenic av stora minnesluckor, vilket hans oroliga föräldrar har lagt märke till?

Nationell hälso- och sjukvård – Hur en mans samvetsgranna
ansträngningar att återfå hälsan användes emot honom
Sverige är ett socialistisk land. Landets hälso- och sjukvård administreras av staten, till skillnad från privat hälso- och sjukvård där patienten åtnjuter sekretessen mellan läkare och patient. I ett socialistiskt system är din patientjournal statens angelägenhet. I Domenic Johanssons fall, användes Christers patientjournal från tidigare år slutligen emot honom. Efter jordbävning och familjens emigration tillbaka till Sverige, drabbades Christer en period av kraftig depression. Trots det gjorde han rätt. Han erkände detta tillstånd och sökte
hjälp från det svenska sjukvårdssystemet. Efter en psykiatrisk utvärdering, fick Christer den antidepressiva medicinen Seroxat (också känt som Paxil). Olyckligtvis kan denna läkemedel ha allvarliga bieffekter och Christer föll offer för några av de värsta, inklusive beroende. Ännu en gång gjorde Christer det rätta. Han erkände sitt ytterligare försämrade tillstånd och sökte igen hjälp från det svenska sjukvårdssystemet, som denna gång erbjöd det populära svenska botemedlet mot depression: elektrokonvulsiv terapi (ECT). Eftersom Christer är en välinformerad och intelligent man, kände han redan till farorna med ECT och avvisade den psykiatriska klinikens erbjudna botemedel. Christer konstaterade att han bara hade en valmöjlighet: att vänja sig av med Paxil, något han lyckades med efter flera månader. Olyckligtvis för Christer är svenska medborgares patientjournaler inte privata. Alla myndigheter eller anställda, verkar det som, kan få tag på en medborgares journal. Som i oräkneliga andra barnavårdsutredningsfall, erhölls Christers patientjournal av Visbys socialtjänst och de ofta motstridiga diagnoserna på Christers mentala tillstånd 2003 användes 2009 emot honom. Som svar på detta begärde Christer en ny psykiatrisk utvärdering. Den senaste psykiatriska utvärderingen dokumenterar Christers ansträngningar och tillhandahåller en ny utvärdering och slutsats av Visbys vuxenpsykiatriska avdelning som är daterad 11 oktober 2009. Enligt rapporten, vilken lämnades in i sin helhet till kammarrätten, är Christer frisk och helt fri från någon mental sjukdom eller annan diagnos. Även med denna senaste psykiatriska utvärdering som visar både att Christers depressiva sjukdom och de allvarliga bieffekterna han drabbades av från den psykiatriska medicineringen tryggt ligger i det förgångna, fortsatte domstolen att insistera på i sitt beslut i december att Christer lider av en psykiatrisk sjukdom. Förvånande nog tillerkänns denna ”diagnos” i det skrivna beslutet ”… enligt socialnämndens uppfattning en faktor som påverkar Christer Johanssons
omsorgsförmåga”. Bevisligen väger åsikten från en professionell psykiatriker vid Visbys vuxenpsykiatriska avdelning mycket lätt i Stockholms kammarrätt i förhållande till en ”uppfattning” hos personalen på Gotlands socialtjänst.

Terroriserade till underkastelse
Även om Annie och Christer stod på sig mot socialtjänsten på Gotland i försvar för sina rättigheter som föräldrar att uppfostra och skola Domenic hemma, så hade det svenska LVU-systemet snart terroriserat Annie och Christer till fullständig underkastelse efter att pojken blev beslagtagen. Som det noterade i kammarrättens beslut i december 2009, så var Christer uppenbarligen en man som hade tvingats till underkastelse. Beslutet noterar att Christer går med på allt som socialtjänsten på Gotland kräver. Paret Johansson gick med på att skriva in Domenic i skolan, att han skulle få alla vaccineringar, att han skulle få all annan hälso- och sjukvård och psykiatrisk vård som bedömdes nödvändig för Domenic av socialnämnden. De gick till och med så långt att de höll med socialnämnden om att Domenic var psykologiskt försenad som ett direkt resultat av att han inte hade gått på dagis, i förskola eller första klass. Paret Johansson befann sig exakt där Visbys socialtjänst ville ha dem: i fullständig underkastelse. En domstol som verkligen var bekymrad över ett barns välmående, oavsett hur vilseledd den var, skulle här ha dragit slutsatsen att med fullt samarbete från familjen vad gäller alla de olika terapeutiska förslagen, så borde behovet av att flytta barnet inte längre existera. Men detta var inte socialtjänstens mål.

Moment 22: Den yttersta grymheten
I december 2009, sex månader efter att deras käre son slets bort från dem, var Christer en man som var fullt villig att samarbeta med Visbys socialtjänst i ett försök att återföra Domenic till sin familj. I ett svuret uttalande inför kammarrätten, gick denne far med på att följa hela den vårdnadsplan som planerades för Domenic, med undantag för att Domenics vård skulle tillgodoses medan han fortsatte att bo i det föreskrivna familjehemmet. Paret Johansson var villiga att göra allt och vad som helst socialtjänsten på Gotland krävde, så att de till slut skulle få sin son återlämnad hem. Den grymmaste aspekten av detta fall är fräckt registrerat i domstolsbeslutet i december 2009. I ett moment 22-scenario förlorar alltså paret Johansson sin son om de går med på hela LVUvårdplanen, vilket innefattar föreskriven familjehemsplacering; och paret Johansson förlorar sin son om de går med på hela LVU-vårdplanen, med undantag av den föreskrivna familjehemsplaceringen.

I sin slutsats skriver domstolen: ”Frågan är härmed om behövlig vård kan ges på frivillig väg. I vårdplanen anges bl.a. att Dominic ska vara placerad i familjehem, vilket Annie Johansson och Christer Johansson inte har samtyckt till. Kammarrätten kan därmed konstatera att erforderligt samtycke till behövlig vård inte föreligger. Vid sådant förhållande ska länsrättens beslut att bereda Dominic vård enligt LVU stå fast. Överklagandena ska därför avslås.” Med andra ord, paret Johansson underkastade sig alla krav från socialtjänsten på Gotland. Dessa krav inbegrep vad vissa skulle beskriva som ett framtvingat domstolserkännande att de hade gjort felaktiga val för Domenic vilket socialtjänsten anklagade dem för. Kraven inbegrep också att paret Johansson måste gå med på allt i LVU-vårdplanen, inklusive den föreskrivna familjehemsplaceringen för sin son. Därför var de utdömda om de underkastade sig alla krav och utdömda om de inte gjorde det. Den maximalt möjliga fogligheten uppnåddes med denna lidande familj, inklusive förnekandet av deras eget naturliga levnadssätt. Sedan, när de befann sig i fullständig underkastelse, förnekades de allting.

Hur ska man förstå detta fall?
De enkla och tydliga fakta är dessa: Ett kärleksfullt, lyckligt och hälsosamt barn togs utan rättsprocess från sina föräldrar av obestämbara (och felaktiga) ideologiska skäl. Hans familj blev sedan straffad för det trauma den hade upplevt, och därför att de inte helt enkelt fogade sig i förlusten av sitt barn. Det finns inget lagligt, inget logiskt och inget rättvist i detta scenario. Att detta kan hända i ett modernt och efter vad man kan anta demokratiskt land är helt obegripligt. Alla fria välvilliga medborgare, i alla världens länder, borde vara oroade när en stat har makten att ohindrad agera på detta sätt. Detta fall borde angå oss alla. Alla föräldrar, alla familjer, och alla som tror på mänskliga rättigheter och mänsklig värdighet.

General Overview

On June 26th, 2009, Domenic Johansson, a seven year-old boy (born on September 9, 2001) who is a dual citizen of Sweden and India, was seated in a commercial airliner awaiting departure of a flight to India. Without a court order or any kind of preliminary notification, Swedish authorities boarded the plane and removed Domenic from the custody of his parents, Christer Johansson (a Swedish citizen) and Annie Johansson (an Indian citizen). The sole purpose of the removal of Domenic was to prevent his parents from moving with him to India.
At the time of the removal, the sole issue that motivated the actions of the Swedish government was the fact that Domenic was being homeschooled. No other information concerning minor medical issues (which have arisen since the boy was unlawfully removed from his parents) was known to any Swedish authority at the time he was peremptorily removed from his parents.
Swedish officials removed this boy from an international flight solely to prevent his parents from moving to another nation and from educating him in a manner that is lawful in India, in Sweden, and in a majority of nations.

A Review of the Egregious December 2009 Court Decision Allowing Social Services to Keep Little Domenic in State Custody

It was one year ago today, June 25, when armed police, at the behest of Social Services of Gotland, stormed an Indian bound jetliner in Stockholm, Sweden, and forcibly removed the Johansson family. Their crime? They had briefly home schooled their only child in a land which looks upon home schooling families with contempt, and just this week passed a new education law making home schooling illegal across the Swedish landscape. This story examines the life of the Johanssons and the December 2009 Swedish Chamber Court Decision which essentially holds a family captive on the Swedish island of Gotland.

When cultures collide

Because his mother is Indian, Domenic grew up somewhat different from the average Swedish child, naturally adopting Indian ways and customs. Annie, the now 8 year-old boy's mother, believes in a simple life where mothers raise their children by hand until school age. Therefore, Annie and her husband Christer never enrolled Domenic in Swedish day care and preschool and were repeatedly harassed by Social Services of Gotland for their choice to raise Domenic at home.

In Sweden, it is the rare child who does not attend day care while mother rejoins the workforce. Domenic and Annie were the exception, and not the rule. Therefore, their way of life attracted attention. Mother and child remained home with each other daily, enjoying the most natural of relationships. Yet shockingly, in the December 2009 court decision to continue holding Domenic in state custody, the fact that Domenic was never placed in day care was held against the family. According to the December 2009 court document, "...the parents have taken a risk with not letting Domenic participate in child care and schooling." When, in the history of humanity, has it been a "risk" for a mother to raise her child at home herself?

"Lives in the shadow"

The court has clearly held Annie's position as a foreigner in Sweden against her. You see, Annie's native tongue is English, yet she has learned to speak and read some Swedish over time since emigrating to the country in 2001. On the other hand, Christer speaks both Swedish and English fluently, as does Domenic. Over the years, Christer has done most of the translating and speaking for Annie. Gotland Socials have interpreted Annie's reliance upon her husband to communicate for her as a weakness, as cited in the December 2009 court document, stating, "Annie Johansson lives in the shadow of her husband." If you moved to a foreign country with your spouse, who grew up in that country, would you not also be heavily reliant upon your spouse if you did not speak the language well? Would such a reliance make you an unfit parent?

Mother earns Masters but "lacks ability"

Annie received her BA from the University of Poona in 1994 and then her MA from the University of Pune, 1996. She also pursued additional education by earning a First Class diploma in Advertising and Public Relations, also in 1996, from the Bombay Institute of Management Studies, as well as a diploma of Distinction in Information and Systems Management from Aptech Computer Education school in 1998. Yet, Social Services of Gotland managed to convince the Chamber Court judge that while Annie has the "will" to be a good mother, she, a multi-degreed individual, hasn't the "ability." The December 2009 Chamber Court decision states, "Christer Johansson and Annie Johansson have a will to act as good parents but lack ability." Do you have a Masters degree, or perhaps just a Bachelors degree? If so, did your degree take a certain amount of knowledge, self-discipline, maturity and "ability" to obtain?

A bereaved mother's "present state"

According to the Johanssons, in the fall of 2008 Social Services of Gotland began actively investigating and harrassing them after the family notified the local school of their intent to home school Domenic for a brief time prior to their move to India. Compulsory school age is 7 in Sweden. Domenic turned 7 in September of that year. At the time, home schooling was still legal in Sweden. In light of the pending emigration to India, the Johanssons were acting in the best interest of their son by making an educational choice which would naturally minimize disruption to his studies while they moved.

Even though home schooling was at the time legal in Sweden, many in positions of governmental authority are against the practice, as demonstrated just this week when on June 22 the Swedish Parliament approved a new Education Act making home schooling illegal in Sweden. In 2008, the Johanssons were met with resistance to their home school plans from officials at the local Gotland schools, as well as from employees Social Services. Thus, the interrogation and investigation of the Johanssons began. Because it was their legal right, the Johanssons stood their ground and home schooled Domenic through his first school age year.

By the school year's end, the harassment from Social Services took its toll on Annie, but she persevered nonetheless. However, since Sweden has "kidnapped" her son, Annie's health has greatly deteriorated, as noted in the December 2009 decision, "Her present state strongly affects her ability to be a parent."

Let's consider this in context: By December 2009, the Johansson family had been terrorized by the Social Board of Gotland for more than sixteen months; had their home swarmed and searched by armed Swedish police; had been pursued by armed police, at the request of the Social Board, to the very tip of the tarmac at an international airport; had watched helplessly as armed police stormed the jetliner upon which they were passengers; had been forcibly removed from the airplane; once back in the airport had been tricked into allowing the Socials to separate Domenic from them by stating they were simply taking him "to the room next door" only to find out minutes later that he had been wisked out of the airport and was headed back to Gotland and into forced foster care. They had endured numerous meetings with the Socials pleading for the return of their son; were lied to when told he'd be returned in three days; were accused of neglecting him because of two cavities discovered in his baby teeth, after the fact, during those three days in state custody; they'd been through three levels of court cases attempting to have their son returned to them; they'd not been allowed to see their son except for one hour every five weeks. All of this trauma perpetrated by the state, and the Chamber Court judges Annie's fitness as a parent based upon her "present state." How ironic that the same people who created terror and chaos in the Johansson's lives are those who now claim that Annie is unfit to parent in her "present state." The Swedish Social Services of Gotland have violated and torn apart a peaceful and loving family. Now they punish that family for their suffering.

Parent's agony labeled "lack of skill" during supervised visits
The December 2009 decision indicates that Domenic and his parents do not know how to interact with each other during state-supervised visits. Specifically, the document states, "Both Christer and Annie Johansson show a lack of skill...There is a lack of dialogue and interaction from both sides."

Since Domenic's seizure, Annie and Christer have battled the fight of a lifetime against forces with seemingly unlimited power and resources. They are allowed to see their only child for one state-supervised hour every five weeks, and are permitted to speak with him for one state-monitored ten minute telephone call every two weeks. During these times of fleeting interaction with their son, Annie and Christer are severely restricted in what they can say and do in Domenic's presence and they are watched constantly.

During one visit, Annie, overwhelmed by her emotions at seeing her son after such a long separation, began to cry. Instead of understanding and sympathizing with the pain Domenic, Annie and Christer were experiencing, the attending social worker threatened them, telling them if Annie cried again the visit would end immediately. Can you imagine being threatened to lose your one precious hour every five weeks with your child simply because you've behaved naturally, as a brokenhearted mother who is losing her child? Is it any wonder all three of them, Domenic, Annie and Christer, don't know what to say or how to conduct themselves under the ever present microscope of an attending social worker? Yet, in the December Chamber Court decision, this family is accused of having a "lack of skill" in meeting each other under impossible conditions. Again, this family is punished for suffering created by the state.

How far must we stretch our imagination to understand the strain a parent-child relationship suffers once social services removes a child from his home? Since their separation, Domenic, Annie and Christer have suffered great turmoil and impossible adjustments. Looking forward to beginning his new life with his parents and large family in India, Domenic instead was forced to live in a stranger's house in Sweden. At the time he would have begun school in India, he was forced to begin school in Sweden. On his 8th birthday, the heartbroken boy was denied permission to see his parents. When his first Christmas away from home arrived, he was again denied permission to visit or even talk by telephone with the parents he's always loved and adored. Instead, Domenic was forced to celebrate his birthday and the holiday season with strangers while the social workers surrounded themselves with family, friends and loved ones.

There are other restrictions, as well. The Johanssons are not allowed to bring gifts or treats for Domenic. Christer's elderly father and wheelchair-bound mother, Domenic's grandparents, close and dear to him since birth, accompany the family to the state-supervised visits. Unaccountably, at times these gentle people found themselves kept out of the visiting room. No explanation or reason given.

According to the Johanssons, the family has been instructed always to smile when they see Domenic and never to talk about the separation. In essence, they are expected to act as if everything is perfectly fine when they see their son. They are not at liberty to tell Domenic that they do not agree with his living in foster care. They are not at liberty to tell him they are fighting to bring him home. Instead, according to the Johanssons, they are to interact with their son in such a manner that would obviously lead little Domenic to believe his removal from his family is perfectly acceptable to his mother and father.

We have no idea, however, what social workers are telling Domenic. If his mother and father are not allowed to speak of the separation and are not allowed to tell Domenic they are fighting for him, does that not leave Domenic to wonder what his parents are thinking? Doesn't that leave a little boy totally confused about what has happened and at the mercy of whatever message the social workers and foster parents choose to tell him? Children often naturally blame themselves for family difficulties. If Annie and Christer are not allowed to reassure Domenic that he is loved, cherished and wanted back home, isn't this little boy open to very serious and long-term psychological damage? We also wonder what might be happening in Domenic's foster life which perhaps he has been forbidden to share with his parents.

It is clear why Domenic, Annie and Christer do not know what to say or do when they see each other. This family has become nothing more than puppets on the strings of a heartless puppeteer. They've been threatened into doing and saying as little as possible when visiting Domenic. The question remains: what has Domenic been told or gone through which has caused him to no longer interact naturally with his parents? Why does Domenic now suffer huge gaps in his memory, as noted by his distressed parents?

National Health Care - How a man's conscientious efforts to regain health were used against him
Sweden is a socialist country. The country's health care is administered by the government, as opposed to private health care where patients enjoy doctor patient privacy. In a socialist system, your health record is the government's business.

In the Domenic Johansson case, Christer's health records from years previous were eventually used against him. After the earth quake and the family's emigration back to Sweden, Christer suffered a major depressive episode. Yet he did the right thing. He recognized his condition and sought help from the Swedish health system. After a psychiatric evaluation, Christer received the anti-depressant medication Seroxat (also known as Paxil). Unfortunatly, this drug can have severe side effects and Christer fell victim to some of its worst, including dependency.

Once more, Christer did the right thing. He recognized his further deteriorating condition and sought help from the Swedish health system again, at which time he was offered the popular Swedish depression remedy: Electroconvulsive Therapy (ECT). A well informed and intelligent man, Christer already knew the dangers of ECT and turned the psychiatric clinic's offered remedy down. Christer found he had only one choice: to wean himself off Paxil, which he succeeded in doing over several months.

Unfortunately for Christer, health records of Swedish citizens are not private. Any government agency or employee, it seems, can obtain a citizen's records. As in countless other state child protective cases, Christer's health records were obtained by Visby Social Services and the often conflicting diagnoses of Christer's mental health condition in 2003 and 2004 have been used against him in 2009. In response, Christer requested a new psychiatric evaluation. Dated October 11, 2009, the newest psychiatric evaluation documents the history of Christer's struggles and provides a new evaluation and conclusion by Visby Adult Neuropsychiatry Department. According to the report, which was submitted in full to the Chamber Court, Christer is said to be healthy and completely free of any mental illness or other diagnosis.

Even with this latest psychiatric evaluation demonstrating Christer's depressive illness, as well as the severe side effects he'd suffered from the psychiatric medications are safely in the past, the court continued to insist in its December decision that Christer suffers from psychiatric illness. Surprisingly, the written decision attributes this "diagnosis" as "...according to the social services' understanding a factor that affects Christer Johansson's ability to care." Evidently, the opinion of a professional psychiatrist with Visby Adult Neuropsychiatry Department holds little weight in the Chamber Court at Stockholm over an "understanding" by personnel at Social Services of Gotland.

Terrorized into submission
While Annie and Christer stood their ground against Visby Social Services of Gotland in defense of their parental rights to raise and school Domenic at home, after the boy was seized the Swedish LVU system soon had Annie and Christer terrorized into complete submission. As recorded in the December 2009 Chamber Court decision, Christer was obviously a man brought to his knees.

The Decision records Christer as agreeing to everything Social Services of Gotland demanded. The Johanssons agreed to enroll Domenic in school, to obtain all immunizations, to provide any other health and psychiatric care deemed necessary by the social board for Domenic. They even went so far as to agree with the social board that Domenic was psychologically delayed as a direct result of not attending day care, preschool and the first grade. The Johanssons were exactly where Visby Social Services wanted them: in complete submission. A Court truly concerned with the child’s wellbeing, however misguided, would here have concluded that with full cooperation from the family in every possible therapeutic suggestion, the need to remove the child should no longer exist. But this was not the aim of the Social Services.

Catch 22: cruelty at its utmost
By December 2009, six months after their precious son was ripped from them, Christer was a man willing to cooperate fully with Visby Social Services, in an effort to restore Domenic to his family. In a sworn statement before the Chamber Courts, this father agreed to follow the entire care planned devised for Domenic, with the exception that Domenic's care be provided while he continued to live in mandatory foster care. The Johanssons were willing to do everything and anything Social Services of Gotland demanded, so they might finally have their son restored home.

The most cruel aspect of this case is boldly recorded in the December 2009 Court decision. In a Catch 22 scenario, the Johanssons lose their son if they agree to the entire LVU care plan, which includes mandatory foster care; and the Johanssons lose their son if they agree to the entire LVU care plan, with the exception of mandatory foster care. In conclusion, the court wrote, "Question is therefore if needed care can be given voluntarily. In the care plan is, among other things, said that Domenic should be placed in a foster home which Annie Johansson and Christer Johansson have not agreed to. Chamber Court can therefore state that needed consent to needed care is not present. In such a case, the Provincial Court’s decision to give Domenic care according to LVU should stand. The appeals should therefore be denied."

In other words, the Johanssons submitted to every demand of the Social Services of Gotland. Those demands included what some would describe as a coerced court admission that they had made wrong choices for Domenic as accused by Social Services. The demands also included that the Johanssons must agree to everything in the LVU care plan, including mandatory foster care for their son. Therefore, they were damned if they submitted to all demands and damned if they did not. The maximum possible compliance was obtained from this suffering family, including denying their own natural way of life. Then, when they were in complete submission, they were denied everything.

How to understand this case?
The plain and simple facts are these: A loved, fortunate and healthy child was taken without legal process from his parents for indeterminate (and faulty) ideological reasons. His family was then punished for the trauma they had experienced, and because they did not simply acquiesce in the loss of their child. There is nothing legal, nothing logical, and nothing just in this scenario. That it could happen in a modern and supposedly democratic nation defies belief. Any free citizen of good will, in any country of the world, should be concerned when a government has the power to act in this way unhindered. This case should concern all of us. All parents, all families, and all who believe in human rights and human dignity.

Socials fast-track new case in Harrold-Claesson's absence

The struggle continues for little Domenic Johannson, seized by police from his agonized parents because he was briefly homeschooled, stayed home with his mother as a preschooler, and was reportedly too affectionate and outgoing. Close observers of the Johansson state-sponsored "kidnapping" case believe the Visby Social Board is pushing Swedish courts to fast-track a new series of court challenges in an effort to have the cases quashed long before Ruby Harrold-Claesson wins her way back as counsel to Domenic's parents, Annie and Christer Johansson.

Earlier this month, Swedish courts banished Harrold-Claesson from the case after Domenic's appointed public "defender" (who is appointed by the court to represent the state) complained to the courts about her participation. Harrold-Claesson, president of the Nordic Committee for Human Rights, is a widely known and respected advocate for families in custody disputes with child protective services, and has won many such cases in Sweden, restoring dozens of children back to the rightful arms of loving parents. She has since filed an appeal to her court ordered removal.

Word has it the next series of law suits might be heard as early as the second week of July in Swedish courts on the island of Gotland. This new case, challenging the "keeping" of Domenic, was filed on behalf of the Johanssons by Harrold-Claesson just days before she was banished.
The previous series of cases challenged the initial "taking" of Domenic. In those series of suits, the Johanssons were "represented" by court appointed counsel, resulting in Domenic's continued seperation from his parents. It is for this very reason Christer Johansson has dismissed the original court picked counsel and sought out the hard-hitting Harrold-Claesson to represent him.

June 25, 2010 marks the one-year anniversary of the violent seizure of the then 7-year-old child. So traumatized was Domenic by the acts of armed police on behalf of the Visby Social Services board, witnesses tell us he vomited during and shortly after the shocking scene when uniformed Swedish police stormed an India bound jetliner just moments before take off. We are told the boy's mother, Annie, collapsed during the assault. The family was emigrating to India, Annie's home country.

By the end of 2009, the Johanssons had lost all their court appeals challenging the "taking" of their only child. In the December 2009 Chamber Court decision, the court sites as justification the fact that Domenic was home schooled (at the time legal in Sweden), that his parents chose to delay or forgo immunizations (also legal in Sweden) and that the boy had two cavities in his baby teeth.

Annie is a native of India. She emigrated with Christer to his native country of Sweden in 2001 after an earth quake hit India and the couple lost everything they owned. At the time of the quake, Annie was pregnant with Domenic. The couple always planned to return to India where Annie's large family resides, and were finally doing so the day Domenic was seized.

Alla känner alla. Kollegor, vänner, släktingar och hela systemet har varit intakt. Fram tills nu då fallet Dominic är på tapeten.

För 7 år sedan lämnade jag denna ö för gott. Jag skulle inte ens våga åka dit på semester längre. Och hade jag varit troende skulle jag bett flera gånger/dag att den hemska handläggaren blir avskedad och aldrig någonsin får arbeta med barn igen. Tidningar skriver sällan om LVU-fall med hänsyn till barnens bästa och sekretess. Barns bästa? Är det att de blir statens egendom som väljer nya föräldrar åt dem?

Visste ni att i Stockholm så utreds vart 10:e barn av socialtjänsten? Enligt någon statistik jag läst och redan glömt.

Jag vet att jag inte är ensam om att ha blivit granskad av denna myndighet, men ändå är det något jag skäms oerhört för, har svårt att förlåta och knappt klarar av att tänka på utan att hjärtat skenar och det känns som jag skall få hjärnblödning.

En ursäkt kommer jag aldrig få. Men jag försöker förlåta. Ibland har jag lust att skriva till denna kommun och begära de 6 miljoner de slängde ut på mig som "lyckad behandling" i deras statistik. Jag är densamma nu som då och borde man inte kunna reklamera det hela? Om inte annat borde de ge mig och mina barn detta i skadestånd.

Sex miljoner och det enda jag begärde var en färdbiljett till fastlandet. Jag tror de ångrar bittert att de inte bokade SJ istället med tanke på hur allt utvecklade sig. Kort och koncist: de missbedömde mig totalt ;-D

Världen tittar allt mer på er lilla ö och bildar sig en väldigt osmickrande uppfattning om hur ni behandlar människor som till synes verkar bete sig en aning utanför normen. Handlingarna utförda av era socialarbetare, möjliggjorda av er Kommunledare och sedan rättfärdigade av bisarra domslut i era rättssalar visar hur lite Sverige egentligen beskyddar vuxna och barns rättigheter och värdigheter. Ni borde skämmas för hur ni har behandlat denna familj med ringaktning och yttersta respektlöshet gentemot deras grundläggande mänskliga rättigheter.
När er ambassads attaché (Stig Bergland) skrev till mig om saken hade han fräckheten att citera FN:s Barnkonvention för mig och peka ut att "barnets röst" skall vara utgångspunkten i fall som dessa. Förväntar ni er på allvar att jag, eller någon annan, tror att ni rådfrågade Dominic huruvida han ville bli traumatiskt separerad från sina föräldrar? Förstår ni skadan ni åsamkat denne lille pojke och hans familj vilket för tankarna oavbrutet till vad Stalin gjorde när han skickade iväg människor till arbetsläger för att de hade avvikande åsikter?
Snälla ni, jag har läst rättens beslut. Säger era socialarbetare och domare att det är O.K. att kidnappa den här pojken och att begränsa hans mammas och pappas besök till en timme var femte vecka?
Detta för att Dominic hade några hål i tänderna, inte var vaccinerad och var hemskolad?
Oerhört monstruöst. Helt enkelt omänskligt. Jag skäms över att erkänna att min farfarsfar Gustav Rosequist och Fannie Linbeck var från Sverige. De emigrerade dock till Ungern, en plats där regeringen i jämförelse med Sveriges inte behandlar folk på detta omänskliga sätt. Ni kan inte rättfärdiga vad ni har gjort genom att säga att ni följde lagen eller försökte skydda Dominic, ert beteende och era handlingar vittnar obönhörligen om att ni inte ens tror era egna ord.
Beteendet er Kommun har uppvisat i detta fall har varit ytterst föraktligt, utan ett spår av medmänsklighet eller sympati. Era sporrade socialarbetare har med dumdristig stolthet fabricerat "bevis" för att överskyla vad som med rätta borde benämnas som ett övergrepp. Ni har och fortsätter orsaka stor skada mot denna familj genom er kompromisslöshet. Det ligger i Er makt att sätta stopp för denna mardröm och uppvisa att ni faktiskt äger mänsklig natur såsom medlidande och bedömningsförmåga. Mitt förslag är att ni tar tillfället i akt att lösa problemet genom att återbörda Dominic till sin familj med en ursäkt samt låter dem fortsätta med sina liv så att de kan försöka reparera vad ni nästintill irreversibelt slitit isär.
Om ni måhända inte känner till det finns det en Facebookgrupp med över 2000 medlemmar från hela världen som ständigt växer, gruppen kallar sig "Return Dominic Johansson". Jag kan försäkra er att denna grupp inte kommer försvinna, den kommer tvärtom växa sig större och allvarligt skämma ut er och ert land. Om ni däremot återbördar Dominic om så även utan en ursäkt kommer denna fråga att dö ut efter ett tag. Det är min rekommendation till er. Uppenbarligen är valet upp till er. Jag hoppas att ni fattar det rätt.

I invited 280 of my friends and just sent the following email to the leaders of the Gotland Kommun: Dear Gotland Kommun Leaders: I am very familiar with the details of the taking of Dominic Johansson as I have been in contact with this family since September 2009 becaus...e of your actions which have denied this family basic and fundamental human rights. The world is increasingly watching your little Island and is catching a very unflattering view of how you treat people who appear to behave a little outside the mainstream. The actions taken by your social workers enabled by you, the leaders of the Kommun, and then ratified by outlandish judgments of your courts show how little Sweden really protects the rights and dignity of adults and children. You should be ashamed and embarrassed by the way you have treated this family with contempt and utter disregard for their basic human rights. When your Embassy official (Mr. Stig Bergland) wrote me about this matter he had the audacity to quote to me the UN Convention on the Rights of the Child and pointed out that the “voice of the child” was the starting place in matters like this. Do you seriously expect me, or anyone, to believe that you consulted Dominic and asked him if wanted to be traumatically separated from his parents? Do you understand the harm you have caused this little boy and this family – it is reminiscent of what Stalin did to people sending them off to labor camps because he disagreed with their opinion? Please – I’ve read the court documents. Your social workers and judges said that it is ok to kidnap this little boy and keep the Mom and Dad from visiting him except for 1 hour every 5 weeks? Because Dominic had some cavities and wasn’t vaccinated and was homeschooled? Preposterous and monstrous. Simply inhuman. I’m ashamed to admit that my great-grandparents Gustav Rosequist and Fannie Linbeck were from Sweden. They, however, emigrated to Hungary – a place where it seems, at least compared to Sweden, the government does not treat people in this inhuman way. You cannot justify what you have done by saying that you were following the law or trying to protect Dominic – your behavior and actions since are at odds with any attempt to hide behind such lame assertions. The behavior of your Komun in this case has been utterly despicable - without compassion or sympathy. Your workers have dug in their heels and with foolish pride and are manufacturing “evidence” to cover up what can only be described as an atrocity. You have and continue to cause great harm to this family and boy by your intransigence. It is in your power to stop this nightmare and demonstrate that you possess human qualities like compassion and judgment. My suggestion is that you take the opportunity to make this issue go away by returning Dominic to his family with an apology and allow them to go on with their lives and to try to put back together what you have very nearly irreparably torn apart. In case you didn’t know there is a face book page with over 2,000 people from all over the world (and growing steadily) - the fan page is called “Return Dominic Johansson”. I can assure that this case is not going to go away – it is going to pick up steam and it is going to severely embarrass you and your country. However if you were to return Dominic (even without an apology) this issue would die down after a while. That is my recommendation to you. Obviously the choice is up to you. On June 25th of 2009, officials of Gotland, Sweden boarded a plane bound for India and removed Domenic Johansson from his parents’ custody without a warrant or reasonable cause to believe that he was being harmed. Their supposed crime? Choosing to home school Domenic and to delay or decline certain immunizations. Ironically, home schooling is legal in Sweden, and historically parents have always been given the option to legally delay or decline immunizations if they thought it in the best interest of their particular child or children. Born in Jamaica, she married Hakan Claesson and settled in Sweden, where she specializes in cases in which children have been taken by state or other governmental officials.

"The lawyer is a real freedom fighter," Michael Donnelly, an executive with the HSDLA, told WND. "She goes toe-to-toe over this issue. She's a fighter for the family in Sweden."

She has studied law and political science in France and has done post-graduate studies in legal history and her law degree in Sweden. She has presented several cases of human rights breaches to the European Court of Human Rights in Strasbourg, France.

Homeschooling was not the only issue regarding taking Dominic Johansson in custody by the social services. But having read the court verdict with all the issues, there stills seems to be no reason for this severe action. The young boy has most likely been much more hurt by the custody action than the conditions in his family. One cannot avoid the thought that the prejudices and lack of knowledge about homeschooling, could have been the pivotal reason for the custody action.
